「官立学校」の輪郭--近代日本教育制度形成期における概念とその周縁

Abstract

本稿は，｢官立学校」の意味内容が，1870年代から1880年代にかけての教育関連法令制定過程においてどのように変遷したかを考えるものである。1872年の学制章程下に，「官立学校」は文部省の経費支出を根拠に広範な概念として登場し，続いて「公学」とも同義とみなされた。1874年，概念上の混乱を解決するために，「官立学校」｢公立学校｣｢私立学校」という三つの学校の種類とその要件が初めて規定された。この布達が戦前唯一の「官立学校｣ 規定となる。｢官立学校」の要件には文部省による設立経費支弁と文部省による直轄とが挙げられた。これを廃止した1879年の教育令は「公立学校｣「私立学校」の要件を定めたが，｢官立学校」については，不干渉の立場に加え，文部省以外の省庁の教育機関の位置づけ，および経費や管理をめぐる概念規定の難しさから，定義が放棄された。1883年の徴兵令改正を契機とし，私学同志社などにより，官立公立学校と同様の猶予特典の付与を求める運動が起こった。その過程で，｢(そもそも定義のない)官立学校に準じる」という概念が生まれた。1884年には財政難に苦しむ府県の教育行政を助けるべく構想された「府県連合学校｣を官立なみに処遇するという「准官立学校」案が提示され，適用対象は私立学校にも拡大された。｢准官立学校」は，府県側あるいは私立学校側が経費を支弁するが，文部卿の直管であり，経費支弁主体と管理主体とを分離した点に新しさがある。｢准官立学校｣ 案の発想は，1886年「諸学校令」中の中学校令による高等中学校制度および諸学校通則により実現した。｢准官立」の名称は公式には用いられなかったが，私学の運動の中では引き続き使われた。以上のように，｢官立学校」の輪郭は不鮮明であったが，それゆえに「准官立｣ という独特な「隠れた制度」を周縁に生み出した点に，近代日本教育制度形成期の特質が認められる。

In the School System Law (Gakusei Shotei 1872), "Government School" was understood in a broad sense. In 1874, the Education Ministry Ordinance defined the three kinds of school, "Government School", "Public School" and "Private School". The Educational Law (Kyoiku Rei 1879) abolished the Ordinance and defined "Public School" and "Private School" but remained "Government School" not to be defined. Some private schools such as Doshisha, began the petition to gain the right to be exempted from Conscription for a while "like Government School". The Department of Education planned the "Quasi Government School" System. It was defrayed by some Prefectural Treasury or the Private fund but placed under the jurisdiction of Minister of Education. The idea was realized as Higher Middle School System or in "General Regulations for Schools" under the new School Ordinances (Sho Gakko Rei 1886) though "Quasi Government School" was not used as the legal term. The Implication of "Government School" was unclear throughout 1870's - 1880's so it produced "Quasi Government School" around itself as a hidden system.
