国有林野の境界保全に関する考察

Abstract

(1) 国有林野の境界保全に関する規定は1951年に制定されたものをそのまま受けついで今日まできているが, それが現状に合わなくなっている。当時は境界標の埋設もまだ十分ではなくまた木標も多いなど, 境界を保全する条件はよくなかった。また戦後の混乱期でもあり境界紛争が起きやすいという背景もあった。(2) しかし, いまや境界の保全条件は当時より格段に向上し, 紛争も少なくなっている。したがって規定は現状に合うように見直す必要がある。(3) 境界保全に関する現行の規定はもとをたどれば戦前にあった2つの別々の規定を一つにしてつくられたが, 必ずしも条文間の整合性がよく図られたとはいえなかった。そのためその解釈に混乱がみられ, 結果として境界保全業務の負担の過重をまねいている。この点からも規定は見直される必要がある。

(1) The regulation on the preservation of the integrity at boundaries of the National Forest which formulated in 1951 has not been functioning well anymore. At the time of the formulation, there were not enough signs constructed yet and the conditions of the preservation of the integrity were not satisfactory such as due to using wooden guideposts. Besides, since the whole Japanese society was in serious confusion after the last war, troubles on the boundaries used to happen quite often. (2) Nowadays, however, the condition of the preservation has been improved remarkably, and there also happens less troubles on the boundaries. These changes in the social and environmetal situations require the consideration of the revision of the regulation to meet the present circumstances. (3) The current regulation on the preservation of the integrity at the boundaries was originally made by the integration of the two different regulations which had been enacted before the world war II. Therefore, the adujustment between the provisions has not always worked well. This caused the confusion of the interpretation of the regulation which resulted in the unneceressary heavy burden of the duties. The regulation should be reconsidered from this point of view as well.
