<研究ノート>規制された寺院における「信仰の自由」の諸相 : サティー犯罪（防止）法によるラーニー・サティー寺院規制を事例に

Abstract

This paper analyzes how a Hindu temple named Rani Sati temple can feasibly be managed after state regulation by the Commission of Sati (Prevention) Act, 1988. Rani Sati temple, situated in northern Rajasthan, commemorates a legendary widow from the Jalan lineage of the Agrawal caste, who is alleged to have followed a custom of widow immolation, namely Sati, in 1295, and became one of the most famous Satimatas (deified immolated widows) in India. Since the Commission of Sati (Prevention) Act was implemented in 1988 to prohibit worship of the immolated widows, the temple has begun lawsuits to protect the basic rights of religious freedom against public interference from the Rajasthan State Government. The precedents of court battles show that the legal legitimacy of the Act is ambiguous. While the Indian state must prohibit Satimata worship, it must protect the rights of religious freedom. Analyzing a series of court battles by the temple, this paper discloses the process forming a legal discourse that gradually curtails the space for worship and the permissive religious activities of the worshippers within the temple premises.

ラージャスターン州ジュンジュヌー市に存するラーニー・サティー寺院は, 中世期に寡婦殉死を経て神格化したサティーマーター (サティーの女神) を祀ったヒンドゥー女神寺院である。しかし1988年サティー犯罪 (防止) 法が施行され, 寡婦殉死とともにサティーマーター信仰も法的に禁止された。それ以来この寺院運営の違法性は問われ, 現在に至るまで多くの裁判が行われている。本稿では1980年代後半からの法廷闘争に注目し, 現代インド社会における宗教実践の場として寺院がどこまでが私的空間で, どこまでが公的空間であると線引きされうるのか, そしてどの程度において信仰の自由が維持されうるのか詳らかにしている。同寺院をめぐる一連の裁判では, 寺院を規制しようとする行政側と運営を実行としようとする寺院運営トラストとの間で信教の自由権が常に論議の中心に置かれてきた。この司法的解釈の変遷から「信仰の自由」の諸相を読み取ることができるのである。
