| 抄録: | This essay has two principal aims. One, to determine how far back in history the crime of conspiring against the state, which occurs in Tang-lu 唐律can be traced, and to clarify the meaning of the term mou fan as well as its political implications. And the other, I shall examine the development of legalism from the Qin to Han through tracing the mou fan punishment. It has been thought that during the Han, Confucianism assumed prominence by outwardly rejecting legalism. I should like to look at the transition from legalism to Confucianism, using the evidence of the newly excavated Qin bamboo slips found at Yunmeng 雲夢. |
