入会の受け皿としての記名共有登記制度の脆弱性

Abstract

平成21年10月27日に山梨県の甲府地方裁判所において, 同県身延町における「入会権不存在確認請求訴訟」の判決が出された. 係争事案は一般・産業廃棄物管理型最終処分場の建設計画をめぐり, 建設賛成派住民(原告)が建設反対派住民(被告)を提訴したものである. 建設予定地の一部にはK集落(K組)の入会地が含まれており, 入会権の存在を根拠に反対派住民が建設反対活動を行っている. そのため, 建設を推進する賛成派住民が, 当該係争地には「入会権は存在しない」ことを確認するために提訴した. 本係争地は記名共有によって登記されている土地である. このように入会地を記名共有で登記し保持し続けている地域は数多くあり, 本係争事例を検証することによって, 記名共有登記制度が入会を担保するための受け皿として十分でないことを提示するのが, 本稿の主たる目的である.

On 27th October 2009, the Kofu District Court in Yamanashi Prefecture handed down a decision for "the Lawsuit for Confirmation of the Absence of the Right of Common" in Minobu Town located in the prefecture. The disputed suit was filed by the pro-construction residents (plaintiff) against dissident residents (defendant) over the construction plan of the controlled landfill type landfill site for general and industrial waste. Part of the planned construction site includes the common land of Kitagawa Settlement (Kitagawagumi) and the opposing residents are carrying out a protest against the construction on ground of the existence of the right of common. Due to this, the pro-construction residents who are promoting the plan instituted the lawsuit in order to confirm "the absence of the right of common" in the debatable ground thereof. The debatable ground is a land registered under common ownership. Many districts hold such common lands that are registered and retained under common ownership. The main purpose of this article is to present the insufficiency of the registration system for common ownership registration as the legal basis to secure commons.
