<論文>インド憲法制定過程におけるマイノリティの政治的権利をめぐる論争 : ムスリム留保議席の撤廃と「集団の権利」概念の形成

Abstract

インドの制憲過程で見られたマイノリティの権利に関する議論は、マイノリティの文化の維持を保障するためには、個人の権利とともに集団の権利も併せて保障する必要がある、と主張する今日の多文化主義論の、先駆的試みであった。本稿は、国家建設時からマイノリティの問題に取り組んできたインドの経験に注目しつつ、制憲過程を中心とする独立期のインド政治を分析し、その中で「集団の権利」概念がいかに登場してきたかを考察する。ムスリム留保議席の撤廃に至る政治過程を詳細に分析することで、本稿では、会議派指導者は、政治的特権の廃止に納得しうる条件をムスリムに示し、その上で合意形成に必要な時間を用意するなど、性急に結論を出そうとはしていなかったこと、ムスリム留保議席を撤廃するという最終的な決定が、マイノリティの文化の存続を保障する「集団の権利」概念の形成を通じて、ムスリム議員らの同意を根拠に達成されたことを示す。

The debates on minority rights seen in the Constituent Assembly of India was a pioneering attempt in the sense that it arrived at an argument seen in today's multiculturalism which advocates the collective rights of minorities along with the individual rights in order to protect a minority's culture. While taking notice of the experience of India, which has worked on minority issues since its nation-building period, this paper analyzes Indian politics in the days of independence and considers how the idea of the collective rights of minorities appeared in the constitutionmaking process. Through a detailed analysis of political process leading to the abolition of Muslim reserved seats, this paper shows that the Congress leaders never took a hasty decision and that the Constituent Assembly's decision over the withdrawal of Muslim reserved seats was accomplished based on the agreement of Muslim members obtained by giving collective rights to secure the existence of Muslim culture, while providing time for consensus building within the Muslim community.
