在朝鮮領事館警察の「軽犯罪」取締り : ｢違警罪目」を中心に

Abstract

支配側から見て「軽犯罪」の取締というのは，人々の日常に入り，「望ましくない」行為を排 除する基準を示すことになる。19 世紀後半の東アジアにおいては，開港地内の力関係により 「軽犯罪」に対する取締りの規則が急遽作られた。日本における軽犯罪取締は1872年から始ま り，朝鮮においては日本内での実施から10 年も経たないうちに同じ規則が上陸したのである。 本論文の目的は，日本の在朝鮮領事館による軽犯罪取締りの例を通じて，取締りを始めた状況や取締りの対象にされた行為の詳細を検討しようとするものである。 初期領事館警察は，朝鮮で日本(人) の政治的・経済的活路を広げるため居留民を保護しながら，その活路開拓に障害になる「問題居留民」の行動を規制し居留地を安定的に維持することに力を入れていた。朝鮮人との葛藤や武力衝突の規制，「外地」において日本人に向ける視線 を意識した自己規制，移動人口の管理が主な内容である。

From the perspective of those in power the control of 'minor offence' suggests a standard for the elimination of 'undesirable' behaviors from everyday life. In East Asia during the late nineteenth century, rules for the control of 'minor offence' were constructed quite hurriedly in accordance with the power relationships at work in open treaty ports. Laws concerning minor offence in Japan took shape in 1872 and within ten years of being implemented there identical rules arrived in Korea. The aim of this article is to examine the details of conditions at the initiation of such control measures as well as the behaviors targeted by those control efforts through a series of examples of minor offence control by Japanese consulates in Korea. The early Japanese consular police, as they sought to protect Japanese residents and thereby expand Japanese political and economic activity in Korea, put great effort into preserving the stability of settler communities by regulating activity of 'problem residents' (mondai kyoryūmin) that might disrupt those larger goals. Most important among such efforts was the regulation of discord and armed conflict with local Koreans, self-regulation of consciousness concerning how Japanese were viewed by those outside the settler community, and the management of immigrant populations.
