マイケル・ウォルツァーの介入論の研究を通じたjus ad vimの再考

Abstract

本稿は, マイケル・ウォルツァーが提案した, 武力行使全般を取り扱う新たな正戦論の枠組みである「jus advim(武力への正義)」について論ずる. ウォルツァーは, jus advimに合致した武力行使の例と考えられている2011年の国際社会によるリビアへの武力介入に, jus advimに言及することもなく反対した. 本論文では, ウォルツァーの人道的介入論を辿ることで, jus advimを提案しつつリビア介入に反対するウォルツァーの矛盾した姿勢の原因を明らかにすることを試みる. 過去に人道的介入に批判的であったウォルツァーは, 1990年代以降の人道的危機事態の急増により, 介入を積極的に肯定するようになる. 一方で彼は, 介入が共同体および人民の権利の防衛を目的とすべきであり, また文化的・地理的に近い国が介入すべきであるという意見を一貫して保っており, これらの観点からリビア介入を批判する. 彼の介入論の一環であるjus advimにはこれらの政治的意見が前提にあることが明らかであるため, リビア介入に対する彼の態度は矛盾していなかったといえる.

In 2006, Michael Walzer suggested a new framework of Just War Theory called jus ad vim in order to enable the argument of force-short-of-war. The 2011 Libya Intervention is considered to be a case of jus ad vim. However, Walzer opposed the intervention without reference to jus ad vim. The aim of this paper is to clarify the reason for Walzer's contradictory attitude toward the Libya Intervention by tracing his theory of intervention. After a surge of humanitarian crises in the 1990s, Walzer became more affirmative to humanitarian intervention than before. Yet, throughout his works on intervention, he has kept unchanged his political opinions on the purpose and actors of intervention. These political opinions were the basis of his opposition toward the Libya Intervention. Since jus ad vim is part of his theory of intervention, it is clear that his political opinions about intervention are the underlying basis of jus ad vim. Therefore, his critical attitude toward the Libya Intervention was reasonable.
