フーコーにおける法権利について

Abstract

フーコーは権力や統治といった人間の関係に哲学の基礎をおくことで, 「法」と「権利」のそれぞれにおいて独自の革新的な見方をもっていた。本稿では「droit」という言葉の二重性をフーコー哲学に見いだすこと, すなわちフーコー独自の法理論によらない「法」の分析が, 独自の新しい「権利」の用法へとつながっていくことを示している。フーコーによれば権力関係がまず存在し, その関係をコード化するものとして, 法がある。ここから二つの結論が生じる。(1)法が禁止や許可などの作用によって規定する領域の外側に, 法が関知しない別の領域が広がっているわけではない。したがって, 法理論は法というものを把握することに失敗している, (2)法は別の生産的なメカニズムと関連して機能している。これに対して, われわれが手にしている権利は, 法理論や主権に根ざしているため, 狭く貧困なものでしかない。ここにあるギャップのうちに新しい権利を創造する必要性が生じてくる。フーコーの権利とは何か。それは根源的な契約があり抽象的に導かれる権利ではなく, 出来事や闘争として現れる権利である。クラウス・クロワサンのドイツへの強制送還への反対, イラン革命, 難民問題, そしてゲイの権利。存在様式の選択を可能にするために闘い, 新たな文化様式を創造することにつながっている。これは主権によって基礎づけられた個人の権利とは違う。では, いかなるイデオロギーにも基礎づけられていないのであれば, この権利はどこにその正当性をもつのだろうか。それは蜂起, すなわち耐え難さから立ち上がることである。この運動こそが自由と権利に命を与えるとフーコーは述べている。それは権利であるがゆえに価値をもつものではなく, 耐え難さに立ち向かうことで価値をもつ権利のことである。

Foucault had a unique and innovative view of "law" and "right" by keeping the basis of his philosophy in human relations such as power and governance. In this paper, it is shown that the duality of the word "droit" (law and right) is found in the Foucault philosophy, that is, Foucault's unique analysis of "law" is connected with the his usage of the "right". According to Foucault, there is the power relation exists first, and this relation is coded. Two conclusions arise from here. One, the law theory fails to understand the law is acting as a part of a different productive mechanism of power relations rather than sovereignty. Two, the right which we can use is narrow and poor, because it is rooted in the law theory and sovereignty. The need to create new rights arises from this gap. What is Foucault's right? It is not from a fundamental contract, but from an event or struggle. Struggle against the deportation to the Germany of the Klaus Croissant, Iran Revolution, refugee problems, and gay rights etc. It is connected to the creation of a new cultural style by fighting, that enable us the new and different style of existence.
