<研究ノート>佐賀藩の刑法改正 : 徒罪方の設置

Abstract

佐賀藩は天明三年(一七八三) 従来の追放刑と徒罪刑に改めた。これは当藩が改革の手本とした熊本藩主細川重賢による宝暦の刑法改正にならったことはいうまでもないが、佐賀藩としても次にあげるような諸事情があった。(1)商品経済・貨幣経済の発展にともなう農民の商人化、農耕生活からの離脱にともなう農業労働力の減少防止、(2)佐賀平野を貫流する嘉瀬川とその支流川上川の川床隆起による田畑や佐賀城下への洪水防止のための川砂の除去、(3)有田皿山に於ては窯業不振による細工人の他領への逃亡取締等の必要にせまられていた。

The Saga 佐賀 clan amended the penalty of banishment into that of Tozai 徒罪. It goes without saying that it imitated after the Hōreki 宝暦 Amendent by Shigekata Hosokawa 細川重賢, the lord of the Kumamoto 熊本 clan, but the Saga 佐賀 clan itself was under the following circumstances : (1) The change of peasants into merchants with the development of its commodity and monetary economy, and prevention from decreasing of agricultural labour power with the secession from the agricultural life. (2) Removal of the sands for the prevention against a flood into the capital and fields because of the upheaval of the river-beds in the Kase 嘉瀬 River and its branch, the Kawakami 川上 River which run through the plains of Saga. (3) The urgent necessity to control the escape of artisans to the other territories on account of the slump in the ceramic industry in Aritasarayama 有田皿山.
