<研究ノート>一五・一六世紀のネーデルランド全国議会について

Abstract

本稿は、Ｊ゠ジリサンらの所論を批判的に摂取しつつ、一五七六年までのネーデルランド全国議会について、その起源・召集・構成・権限・運営などの諸問題を扱ったものである。まず起源については、一四六四年の集会を重視する定説をあえて否定する理由は見当らないように思われる。ついで上記の諸問題、とくに運営上の手続きに関連して注目されるのは、全国議会を特徴づける州権主義の強靱さである。代議員は全権の行使を許されず、多数決原理も採用されることがなかった。全国議会は各州議会が派遣する代表使節の集会以上のものではなく、法制上確認された単一の制度になることがついになかった。それにもかかわらず州権主義は、君主の集権・統一政策に対抗して旧来の諸特権を擁護する方向に一種の遠心力として作用し、それが全国議会をして「反抗の潜在的中心」たらしめたのであり、独立革命もまたこうした州権主義的志向によって荷なわれることになるのである。

This paper, making critical reference to the views of J. Gilissen and others, deals with some subjects related to the States General of the Netherlands before 1576 : their origins, convocation, composition, competence, procedure, etc. Concerning the origins, there seems to be no reason for the positive denial of the established view which attaches importance to the assembly of 1464. In connection with the above-mentioned subjects, particularly the pattern of procedure, the tenacity of particularism which characterized the States General is worthy of special notice. There, the deputies were never allowed to enjoy the exercise of plena potestas, nor the rule of decision by majority introduced. The States General were no more than a meeting of ambassadors sent by separate provincial estates, nor could they grow to be a unique institution recognized constitutionally. Nevertheless, the particularism worked as a sort of centrifugal force in the direction of guarding the ancient privileges against the centralizing and unifying policies of the rulers, and made the States General "a potential centre of opposition to the monarchy." Such particularistic sentiment was also to be a driving force of the Revolt of the Netherlands in the latter half of the 16th century.
