<論説>一三世紀ダラムの巡回裁判

Abstract

集権性をもって特徴づけられるイングランド封建社会の解明においては、強大な国王権による封建領主権の圧倒、または包摂という図式が一般的である。最近、両者の対抗ではなく共同行為性を重視する学説も現われてはいるが、両者をそれぞれ自立した存在として前提する点では従来の説と同然である。本稿では自立した領主権に介入する王権の強大性の最も有力な証拠とされてきた、国王巡回裁判について、その機能を分析することによって、領主権の自立性を疑い、通説への些かの批判を試みる。封建領主相互間の紛争を調停する役割を、国王や彼が定期的に派遣する巡回裁判官が果たしていたことは既に明らかである。しかしこれは、王による封建領主権への介入あるいは救済とみなされるべきなのであろうか。巡回法廷においては上述の如き調停機能の他に、領主支配下の農民に対する処罰例が見られる。このように国王が領主を差しおいて農民を規制する状況の説明として、本稿では領主による支配共同体説を提起した。例としてイングランド内では最高の独立度を持つダラム・パラチン領における巡回裁判を取りあげる。

At the end of the last century Dr. Lapsley established the classical theory about the county palatine of Durham. He described the county as a microcosm of the realm and modelled the position of the bishops after that of the kings of the Plantagenet. About half a century later Mrs. Scammell critcized the theory of microcosm with the abundant evidences cited from the assize rolls. Her analysis of the rolls could also help us understand the necessity to know more about the jurisdictional system built among those feudal lords in the bishopric. More than five hundred cases in the rolls examined, there can be observed two types of suit; one is about the tenure of those lords and the other is concerned with the punishment of villeins not by their lords but by the jury of regional kights and itinerant justices. Analyzing the latter cases it would be understood that in the thirteenth century those lords established the jurisdictional system which could reconcile their conflicts about tenure and also maintain their rule against villeins : a kind of English solution for the antithesis of private autonomy and social control.
