<論説>参議制の成立 : 大夫制と令制四位

Abstract

参議任官者の帯位は法制上の明文がないにも拘らず実態上大略四位に限定され、その結果令制下の議政官組織は令制議政官(三位以上) と共に四位以上の官人によって構成されることになる。本稿はかかる帯位実態の所以を解明するという観点から、大宝二年(七〇二) の参議制の成立事情について考察を加えた。そして、参議制は、大化前代の大夫(マヘツギミ) 層を実質的に継承する政治的階層としての「四位以上」の存在を背景に、制度的には唐の兼官宰相制度を模倣する形で、令制議政官と一体の議政官として案出されたものであるとの推定に達した。それ故、大宝二年の参議制を単なる「便法」と看做すこれまでの通説にはもはや従いえない。また、右の推定に立てば参議は大宝二年当初よりすでに「正宮」であったと認められよう。かくして、夙に先学によって指摘されている上代貴族合議制は、参議を含めた四位以上の議政官組織の成立によって、大宝令制下においてもなおその伝統的機能を保障されるに至ったのである。

In spite of no provision in the Taihō-ryō 大宝令--Taihō code--, most of the men appointed Sangi belonged to the Shii 四位--the forth rank--. So, the state councilors organization consisted of the men of Shii and the legal state councilors above the Sanmi 三位--the third rank--. Elucidating why the state councilors organization included the men of the Shii, we considered the establishment of the Sangi system in the second year of Taihō 大宝. Consequently, we infer as follows. 1) As the background, the establishment of Sangi system in the second year of Taihō had the existance of the men above the Shii as a political stratum, who substantially succeeded to the Maetsugimi 大夫 stratum before Taika 大化. 2) This system imitated the system of the state councilors in T'ang 唐 who held additional posts. 3) When the Taihōryō was in preparation, the state councilors organization was contrived as a one-set system including the Sangi and the group above the Sanmi. So, we cannot defer to the traditional and popular view which regards the Sangi system of the second year of Taihō as a temporary measure. And the Sangi was already a formal government post from the second year of Taihō. The eatablishment of the state councilors organization including the Sangi ensured the traditional faculty of the ancient mutual consent of the aristocracy even under the Taihōryō system
