<論説>参議論の再検討 : 貴族合議制の成立過程

Abstract

大宝二年五月、「参二-議朝政一」せしむという形ではじめて登場した参議については、これまで律令太政官制にもれた氏族の吸収という理解がなされてきた。これは太政官機構が有力氏族による合議制であったとする見方に基づく一種の氏族均衡論といってよく、近時これに対する疑問からいくつかの参議論も現われたが、参議を当初から議政官とみる点では従来の説の枠内にあるといわざるを得ない。参議のもった本来的な役割は朝政参議=待問参議、すなわち天皇の下問に対して意見を具申する個人的なものであり、むしろ私的・非合議的な性格をもつ点において、大臣以下の議政官とは異質な存在であった。換言すれば、「参議」の制は、当初限定された機能しかもたなかった議政官合議制を補完する役割をになって登場したともいえる。本稿は従来の学説史的反省に立ち、こうした初期の参議(朝政参議) が議政官(廟堂参議) 化していく過程を多角的に考察し、それを通して貴族合議制が熟成され確立していく過程を論じたものである。

The system of the Sangi was framed in May of the second year of Taiho 大宝. It was generally considered that this system was composed of the clans which were excluded from the Ritsuryo-Dajokan 律令太政官 regime. This interpretation is a kind of the clan balance theory which bases upon the viewpoint that the Dajokan 太政官 system was composed of the influential clans. Recently, suspecting it, some scholars proposed new theories on the Sangi. But we can say that these theories are not different from the former theory, because they regard the Sangi as the Gijokan 議政官 from the beginning. Originally the Sangi stated an opinion by request of the Emperor; the Chosei Sangi 朝政参議 was the Taimon Sangi 待問参議. The Sangi played a private role and was of non-representative character. So, it was different from the Gijokan such as the Daijin 大臣. In other words, the system of the Sangi was framed in order to complement the Gijokan council organization. In this article, reconsidering these theories on the Sangi, we try to clarify the change of this early Sangi (Chosei Sangi) into the Gijokan (Byodo Sangi 廟堂参議) and the process of establishment of the aristocratic council organization.
