<論説>紛争の中の教会 : 中世フランドルの聖人伝から

Abstract

一一世紀のフランスにおいては伯の法廷が次第と後退するのにともない、伝統的な法制的枠組みが法制外の要素に対してより開かれた性格をもった。この社会は一方で自由な交戦権に裏打ちされた戦士階層が優越する社会であったが、そのなかにあって教会の対応はどのようなものだったか。教会人は紛争を当事者として戦うことも辞さず、また調停者としても活躍したが、彼らはちょうどその時期に起こってきた新しい救霊の動きを直接・間接に紛争解決のなかに持ち込んだ。『聖ウルスメールの奇跡』と『聖アルヌール伝』はこうした教会人の行動規範をもっともよく示す史料である。両者に共通する多くの点から明らかとなったのは、フェーデだけでなく世俗の解決法の全体そのものが、聖人の平和の標的となっていたという点である。前者が贖罪金に端的に示されるように<命と身体を救済する方法>であったとすれば、後者はそれを<永遠の命を救済する方法>で置き換えるという展望を示そうとしたと生えるのではないだろうか。

With the gradual disintegration of the Carolingian comital courts in 11th century France, the traditional judicial structure found itself increasingly open to extrajudicial elements. How did the clergy respond to this transformation while living in a society dominated by a military class that enjoyed a free right to fighting? While sometimes siding with one party in a conflict and at other times acting as mediators, they also introduced new principles of salvation into the settlement of conflicts; a trend that manifested around the same period. "The Miracles of Saint Ursmer" and "The Life of Saint Arnulf" are among the best sources for understanding the code of action and thought held by the clergy involved. An examination of both sources reveals that the saints challenged not only private war but all secular dispute settlements as well. If lay settlement was based on the principle of "saving life and limb" - payment of "compositio" being the most typical example - then it can be concluded that the clergy tried to replace it with their own principle of "saving the eternal soul".
