フランスにおける2019年8月の公務員参加法制度改革 --協定への法的効力付与に向けた授権、行政社会委員会の新設等--

Abstract

フランスでは、「公務員制度を改革する2019年8月6日法律第2019-828号」により、労働条件の決定過程等に対する公務員の参加を保障する公務員参加法制度が、労働者参加原理に基づき大きく改革された。すなわち、この法律により、(1)関係公務員の多数派を代表する官公吏組合と政府行政当局との締結する協定に法的効力を付与するための規定のオルドナンスへの授権、(2)行政管理委員会と衛生安全労働条件委員会を統合した行政社会委員会の新設、(3)同数人事審議会の設置単位の統合と管轄権の制限、(4)公務員制度共通評議会の管轄権の強化がなされた。以上の法改正のうち、(2)と(3)に対しては、憲法院2019年8月1日判決第2019-790 DC号において、労働者参加原理に違反するかが問題となったが、いずれの点についても違反しないとの判決がなされた。以上を踏まえ、日本の公務員法において、(1)労使間の合意に法的効力を認めるためには、公務員側の当事者に関係公務員の多数派を代表していることを求める必要のあること、(2)今後のフランスにおいて協定への法的効力付与を目指す中でなされることの期待される議論が参考になるかもしれないこと、(3)フランスの労使代表型諮問機関法制を参考にするにあたり、本法律の課題とする点も考慮すべきことを示唆した。

In France, the Act No. 2019-828 of 6 August 2019 on transformation of the public service (loi n° 2019-828 du 6 août 2019 de transformation de la fonction publique) dramatically reformed the legal system on the participation of the public services, considering the constitutional principle of participation of the workers in the collective determination of the working conditions and in the management of the enterprises. The outline is as follows. Firstly, the Act authorized the governmental ordonnance (ordonnance) to grant the legal effect to the collective agreement between the representatives of the public employers concerned and the labor unions representing the majority of the public services concerned. Secondly, it established the social committee of administration (comité social d'administration) in succession to the technical committee (comité technique) and to the committee of hygiene, security, and working conditions (comité d'hygiène, de sécurité et des conditions de travail). Thirdly, it integrated the formational levels of the administrative paritaire commission (commission administrative paritaire) and restricted its competences. Fourthly, it reinforced the competences of the common council of the public service (conseil commun de la fonction publique). The Constitutional Council (Conseil constitutionnel) has decided that the establishment of the social committee of administration and the reforms on the administrative paritaire commission conform to the constitutional principle of participation of the workers. Considering the above, this article makes the following suggestions in designing the Japanese public service law. The first is that the labor unions concluding the collective agreement will have to represent the majority of the public services concerned if the legal effect is granted to the agreement. The next is that the discussions which will be held on granting the legal effect to the agreement by the governmental ordonnance in France might be worth considering. The last is that the problems which the act aims to resolve will have to be recognized when the committee, the commission, and the council on the participation of the public services in France are considered.
