<論説>イギリス封建王政の展開について

Abstract

この論文は、イギリスの強力な封建王政の展開を考察し、その末端組織を補うものとして borh＝personal protection 特に frankpledge system＝territorialized protection が全国的規模において法令化された事の重要性を述べ、次ぎに具体的な封建王政の発展の基礎と考えられるものとして、 (一) 王領地、 (二) 幾多の公共税徴収、 (三) 領主法廷と公共法廷との関係、 (四) 公共法廷の村法－村落共同体の象徴としての－管轄権と云う様な問題を提出し、イギリス・マナー領主権に与えた影響を考えてみたものである。

This article describes the development of the English feudal monarchy, and attempts to consider that the enactments of the borh or frankpledge system contributed to the development of local government. Then it directs our attention to some concrete grounds for the development of the English feudal monarchy, that is (i) the abundance of royal demesne, (ii) collecting of some public services and aids, (iii) the relation between manorial court and popular court, (iv) bye-laws----representative of village community----under the control of popular courts, and surveys their influences upon the English feudal lordships.
