<論説>国衙領における領主制の形成

Abstract

鎌倉時代の一時期に、若狭国で明らかにされるごとく、中世の国衙領は荘園とならんで広大な領域を占めていた。この広大な国衙領は平安末期以来、旧来の徴税領域たる「郷」が解体し、あらたに「別名」が広範なる成立をみせて、それ自体大きな変貌をとげていた。「別名」の形成により、その領主達の領内農民に対する「勧農権」の行使が体制的に確認されるにいたり、時代の進展とともに鎌倉時代の初頭をすぎれば、この勧農権が下地進止権へと継承転化されていくのである。かくして別名の形成とは領主制の生誕を具体的に示すものにほかならぬのであるが、さらにこれは、国衙の各構成員達が、平安末期にそれぞれの職掌に従って国衙の体制を変換させつつ旧来の郷を分割し、数多くの在庁別名を成立させたことによつて、国衙領そのものが体制的に封建的構成へと一定度の傾斜をとげるきつかけともなったものである。

As in a period of the Kamakura 鎌倉 era in the Wakasa 若狭 country, the Kokuga's 国衙 territory in the middle ages occupied as large a territory as the manors did. This large Kokuga's 国衙 land changed largely itself by the dissolution of 'Gô' 郷, the former tax-collection area, and by the newly establisheing 'Betsumyô'別名 at large since the end of the Heian 平安 era. The formation of Betsumyô resulted in the systematically authorized execution of Kannô-ken 勧農権, or right for promoting agriculture, by its lords to the peasants within the domains. As time went on, after the beginning of the Kamakura 鎌倉 era, this right was transformed into the Shitaji-shinshiken 下地進止権. Then the formation of Betsumyô means the concrete birth of the landlord system itself, and it motivated the inclination for systematically feudalistic constitution by the Kokuga's land, as a result of each member of Kokuga dividing the former Gô and forming many Zaicho-betsumyô 在庁別名 by changing the Kokuga's system according to each charge at the end of the Heian era.
