<論説>公田について

Abstract

律令時代の諸史料中には公田という言葉がしばしばみられるが、令集解の説をそのまま適用する、公田は乗田のことであるというような安易な考え方が広く行われ、これについての基礎的研究はまだ行われていないようである。しかし、これの充分な認識なくして律令制的土地制度の変遷、庄園制成立についての正しい理解は成立しえないと考えられる。本稿は斯かる観点から公田の基礎的考察を試みたものである。公田は本来口分田等に宛てられる以前の田地を意味し、耕作すれば輸地子田として扱われたと考えられる。ところが、養老令の施行によつて輸租田として六年間の耕食が許されるに至つた。天長元年には耕食の期間が延ばされ一身の間となり、郷戸制の崩壊と相まつて、公田と口分田は同一の扱いをうけるに至る。天長以降の公田は斯かるものであるが、十一世紀以降は公田に領主権が認められるようになつた結果、公田は不輸租の庄園に対立する言葉―輸租田を意味する言葉―として用いられるに至つた。このような公田の変化に伴なつて、当然のことながら、私田や庄園の意味すみところもまた変ってくるのがみられるのである。

Because of a wide-spread and easy-going conception that Jôden 乗田 stood for the very Kôden 公田 meant by Ryônoshûge 令集解, in spite of a frequent appearance of the word 'Kôden' in resources of Ritsuryô 律令 era, the fundamental study on this point seems to be untouched, but without this full recognition one cannot fully understand the transition of landholding system in Ritsuryô system and. the formation of manorial system. From this point of view this article tries to research Kôden fundamentally. Kôden meant originally farm land before Kubunden 口分田, while it, by being cultivated, seemed to be treated as Yuchishiden 輸地子田. By enforcement of the Yôrô 養老 law, however, it was authorized to earn by cultivating for six years as Yusoden 輸租田; in the first year of Tenchô 天長 the period to earn by cultivating was postponed to life-time. Along with the dissolution of the Gôko 郷戸 system, Kôden was identified with Kubunden. After the eleventh century the authorization of lord right on Kôden resulted in the use of the word Kôden which meant Yusoden correlative against Fuyuso 不輸租 manor. Such transition of Kôden naturally followed change in meaning of Shiden 私田 and manor.
