<論説>品部雑戸制の再検討

Abstract

大化前代の品部制と令制の品部雑戸制を本質的に区別し、前者に対して後者を特色づけるものは、雑戸制である。私はこの体制的転換の行われた時期を律令的中央官僚制がほゞ確立をみた持統期に求めることができると考える。また、雑戸が品部より身分的に低位であるとする通説は正しいが、それでは何故に、法制上良民たること明らかな雑戸が卑賤の民とされたのか、既往の研究ではこれは必ずしも充分に明確にされていない。私は一つの事情として雑戸の軍事的機能を重要視したい。品部雑戸制は前代職業部民をかかる社会的役割を与えられた雑戸を中核に編成したものである。本制度の全体的な構造を明らかにすることによつて、右の課題に迫りたいと考える。

It is the Zakko 雑戸 system to discriminate the Shinabe 品部 system before The Taika 大化 era from the Shinabe-Zakko 品部雑戸 system of Ritsuryô 律令 in itself and to mark the latter against the former. The period of this systematic transition consists in the Jitô 持統 dynasty when the central system of officials in Ritsuryô 律令 was completed. General opinon is correct that the Zakko is personally lower than the Shinabe then the former studies did not explain clearly why the Zakko who was Ryômin 良民 in law was made a humble person. I want to emphasize its military function as one of causes. Shinabe-Zakko 品部雑戸 system was organized on the basis of the Zakko 雑戸 who was given such a social function. I will approach the problem by making clear the whole structure of this system.
