<論説>保証刀禰について

Abstract

律令制の解体過程で、地方政治の実権は郷長から郷司に移行する事が知られている。この郷司のもとにあつて補助的役割を果したと思われる刀禰は、統合力の弱かつた五保の組織に代つて、京師では保、村落では村を単位に在地有力者 (実際に村落に居住し、私出挙なども行い、従類などを従えて、公田・庄田・墾田を耕作する大名田堵的存在の者) であつて、京職及び国衙の所管のもとに、非違の検察、私有地の確認等を任務としていた。また、墾田のみの私有を許された特殊な私有権の段階で、荒野開発の許可、彼等を中心として開発を行うなど、村に於ける共同体的役割をも果していたが、口分田と墾田の所有権の等質化が一般的になつた段階では、刀禰は名主の中に発展的に解消して行つたと思われる。

It is well-known that in the dissolving process of the Ritsuryô 律令 system the real power of the local government shifted from Gôchô 郷長 to Gôshi 郷司. Tone 刀禰, who seemed to do an assistant part under this Gôshi, was a powerful resident man (of Daimyo-tato 大名田堵 existence, really resident in a village, doing Shisuiko 私出挙 and others, cultivating Kôden 公田, Shôden 庄田, Konden 墾田 with followers) as a unit of Ho 保 in Kyoto and of village in the country, in place of the Goho 五保 system with weak power of unification, and his duty was examination of Hii 非遺 and guarantee of a private land under the control of Kyôshiki 京職 and Kokuga 国衙. In case of a special private right owning only Konden Tone acted a part of community in a village, authorizing colonization of a waste land under his leadership : in case of general identification in ownership of Kubunden 口分田 and Konden he seemed to be included in to Myôshu 名主.
