<論説>スパルタの制度とリュクルゴス伝説 : 立法伝説の形成とその時期

Abstract

紀元前五世紀以降、ギリシアの伝承の上では、スパルタの諸制度を整備した人物として、リュクルゴスの名が語られている。しかし、スパルタの諸制度は、当初は、リュクルゴスの名と結びつけられてはいなかつた。 この捌度が、リュクルゴスとの関連において、語られるに至つたのは、何時頃であり、それが如何なる事情によるのか、という点は、これまでの諸研究では、ほとんど、論及されていない。しかし、この間の事情を明らかにせずしては、リュクルゴスの立法伝説の成立について論議し得ないであろう。そこで、私は、先ず、リュクルゴスを考慮に入れずに、スパルタの古制度の成立過程をたどり、所謂「リュクルゴス制度」が、実は、前八世紀初頭と、第二次メッセニア戦争後とに、別個に、成立した制度を合一したものであることを示し、次に、立法事業と無関係であつた、と考えられるリュクルゴスなる人物の素性を探求し、これが、本来は、スパルタの護国英雄であつた、と推論する。以上の二個の問題 (古制度の成立過程・リュクルゴスの来歴) を探求した、その成果の上に立つてはじめて、古制度とリュクルゴスの名とが結ばれた事情を求め得るのであり、かつまた、立法伝説成立の背景を知る手がかりをも得るのである。

Since the 5 th century B. C., Greek legend told Lycurgos as a person who arranged the Spartan state system, but at first the Spartan institutions had not any relation with the name of Lycurgos. Then, when and why this relation was formed have hardly been studied, but without examinating these points, the formation of the Lycurgos legend cannot be discussed. At first, I trace back its origin without any consideration of Lycurgos, and show the so-called 'Lycurgos system' a unification of two systems, one was at the beginning of the 8 th century B. C. and the other after the 2 nd Messenian War. Next, I research the personality of Lycurgos who is thought to have no relation with the legislative work, which is of the real Defender of the fatherland. These two questions, the forming process and a personal history of Lycurgos, are treated in this article, which offer some suggestion to explan the background of formation of the legislative legend.
