<論説>十六世紀末のホロープ法令と債務ホロープ

Abstract

十七世紀ロシアはホロープ制の歴史からいえば、債務ホロープの世紀であつた。債務ホロープを隷属せしめた法的根拠はいわゆる 「スルジーラヤ＝カバラア」 であり、それは十六世紀の過程のなかで普及してきたが、この世紀の末葉のホロープ法令はスルジーラヤ＝カバラアを中心とするホロープ制の変革を企図し実現した。その重点は、(1) スルジーラヤ＝カバラアのもつていた債権＝債務の関係をなくし、ホロープ的隷属の証文たらしめ、主人の死まで移転できない、死後は自由に解放、とした、 (2) 完全ホロープになるものを少なくしようとした、(3) 証文なしの自由奉公人をもカバラア強制によつて債務ホロープ化した、 (4) 完全ホロープたると債務ホロープたるとを問わず、すべてのホロープを国家の帳簿に登録させることにした、の四点にある。登録帳簿によつてこの変革の実態を検討し、十六世紀末葉ホロープ法令の意義を確認せんとするのが、本稿の主題である。

In the 16th century Russia prevailed sluzhilaya kabala as a form of temporary loan de jure. The boyar-creditor endeavoured to secure labor power by this debt bond rather than by old type of kholopstvo. The decrees of 1586 and 1597 instructed much about the sluzhilaya kabala and its registration. Particularly the decree of 1597 made an epoch in the history of Russian kholopstvo. The author tried not only to examine the articles of this decree, but to analyze the registers before and after 1597. The decree deprived the debtor the right to return kabala money and to remove from his creditor, and thus transformed him into kabal'ny kholop. Only the death of his creditor-lord emancipated him. But some bereaved families did not desire to emancipate the kabal'ny kholops. The decree of 1597 held in check the appearance of the complete kholop, on the one hand, and turned the free servant without the bond into kabal'ny kholop by means of making him sign a bond, on the other. The decree of 1597 instructed all kholops to enter in the register no matter whether it be the complete or the kabal'ny, and the registers of 1597-98 proved that the registers before 1597 were neglected and the year 1597 was the new starting-point in the history of Russian kholopstvo.
