<研究ノート>イギリスにおける封建的所領形成への一過程 : folklandとbookland

Abstract

イギリス荘園の原型は、七・八世紀頃より盛行を見る bookland の形成に求められる。つまり、国王の book, charter により当該土地の支配権、自由処分権、世襲権を認められる私有地の形成に求められよう。この私有地 bookland の形成に関して、一九六〇年、Eric John, "Land Tenure in Early England"が発表され、ローマ帝政末の土地譲渡に関する理念が導入されて生じたものであると説明された。そして彼はさらに進んで、Maitland, Vinogradoff らゲルマニストの folkland→bookland なるテーゼを批判し folkland なる、史料に裏付けされることの稀薄な漠然たる既成観念を打破して、bookland 以前には、folkland ではなく、王により保有される土地と、豪族により保有されている土地があつたとする。しかしそれに関する説明は充分納得的であるとは思えない。本稿では、John と Maitland の論議の考証を経て、folkland より bookland へ転換して行く過程に、豪族の folkland 保有と云う過渡期的土地保有形態があつたことに注目したいと思う。

Eric John, "Land Tenure in Early England" was published in 1960 by Leicester University Press. In this monograph, John explains the difference between book-right and folk-right, and asserts that book-rights involved the rights to alienate or bequeath the land, rejecting Maitland's well-known view. And John lays emphasis upon the thesis that this notion of land conveyance was borrowed from the imperial Rome. And then he proceeds to argue that in the seventh century England there were two kinds of land; magnates' lands and royal lands, neglecting the term of folkland. But, John's understanding of what is meant by folkland is not supportable. This note proposes to argue that the received theory of folkland is still sustainable and that the acquirement of folkland by magnates in the early Anglo-Saxon period is an important process of the making of feudal estate.
