<論説>古代の土地売買について (上)

Abstract

この論文は日本古代の土地所有権の性格を究明するために、その一の方法として古代の土地売買の実態を明らかにしようとするものである。本号に於ては先ず問題の所在・視角を明らかにしょうと試みた。即ち当時の売買の用語法として今日の意味での売買と賃貸借の両様の意味があった事を指摘し、更にこのような売買の二義性は遅くも大宝令制定以前から存したを明らかにした。その際最も問題になる三世一身法及び墾田永世私有令の意味を考察する事によって、併せて古代の土地私有権の起源が大化前代に遡る事を明らかにし、上述の推定の裏付けをしようと試みた。

This article is to study the realities of land jobbing as a way of investigating the character of landownership in ancient Japan. At first we try to throw light on the viewpoint of the question. The term of dealing in that time was used both as a meaning of today and that of renting, at least before as late as the enactment of Taiho-rei 大宝令; and to back this presumption, the landownership in ancient times can be traced back to the period before Taika 大化, by studying the meaning of Sanze-isshin-no-hô 三世一身法 and Konden-eisei-shiyu-rei 墾田永世私有令.
