<研究ノート>奈良時代の浮浪と京畿計帳

Abstract

奈良時代の浮浪については、おもに京畿計帳の逃亡に関する注記に基づいて立論がなされてきた。そのさい注記形式の相違が浮浪の実態の相違に応ずるものであることや、京畿計帳にみられる逃亡の様相が、奈良時代の逃亡の一般的様相をも示すものであることが立論の前提とされてきた。しかし京畿計帳を検討してみると、右の前提は必ずしも確実なものとはいえない。また逃亡後六年を経れば除帳されるという令の規定が実行されず、それどころか逃亡者の年齢の変化に応じて、不課口であったものが課口とされて現実に調を負担せしめられ、課口であったものが不課口とされるという不可解な措置さえとられている。今後奈良時代の浮浪を問題にする場合、京畿計帳の史料的性格の十分な検討が必要であろう。

The argument over vagrancy in the era of Nara 奈良 has been made on the commentary upon fugitives in Keiki-keicho 京畿計帳, with the premise that the difference of its commenting form corresponds with that of the realities of vagrancy, while aspects of fugitives in Keiki-keicho show generally those in the Nara era. To consider carefully, the above premise is not altogether an authentic one. The prescription of the order that six-year fugitives be exempted from the code had not been executed; what is more, at least in the case of Cho 調, as persons with remission of duties were made to be those with duties, so persons with duties to be those with remission of duties, which is thought to be incomprehensible measures. Future examination of vagrancy in the Nara era needs thorough study of the character of Keiki-keicho as an original source.
