<論説>居延漢簡劾状関係冊書の復原

Abstract

秦漢裁判制度研究にとって簡牘資料は極めて貴重な資料を提供する。一九七三・七四年出土居延漢簡には「劾状」と呼ばれる一連の簡が含まれ、これは裁判手続きの最初に位置する挙劾の文書であり、挙劾手続き復原の絶好の材料である。この劾状関係冊書の復原作業を通じて、挙劾の具体的手続きを明らかにすることが本稿の目的である。 劾状は文書送付の際に添附される送り状三種類と、ほぼ同内容の文書本文二種類によって構成される。これら構成部分の記載様式や文言・内容の分析や、劾状本文と送り状との組合せの検討を経て、劾状冊書全体が復原される。復原された劾状は異なる機能を持つ二通の文書によって構成され、その二通の文書は送付経路を異にする。かかる文書の作成・送付形態から、挙劾手続き及び裁判制度に関して幾つかの特徴が指摘される。

Recently discovered wooden documents are valuable sources for the study of Qin and Han judicial administration. The 'Hezhuang' documents, discovered in 1973-4, consist of a series of records pertaining to the process of indictment which, when analyzed in their entirety, are particularly illuminating regarding the nature of Han judicial procedure. The 'Hezhuang' indictments include two documents of almost identical content but differing function, and three appended invoices. With these records, one can reconstruct the complex process of indictment and the peculiar nature of Qin and Han judicial administration.
