少年院における処遇と出院時の困難 --教科指導に着目して--

Abstract

本稿の目的は、法務教官による報告事例と法務教官へのインタビューをもとに、少年院における処遇と出院時の困難を明らかにすることである。本稿では、少年院内における処遇のうち教科指導に着目する。本稿で明らかになったことは以下の4点である。第1に、少年院に入院した少年たちは、学校生活への意欲が低いことが明らかになった。このような学校体験を持つ少年たちに、法務教官は少年たちの背景を理解したうえでの関わりを実践していた。第2に、少年院で行われる教科指導は、学力向上を必ずしも意図したものではないことが明らかになった。第3に、少年が中学校に復学しようとする際に、少年院と学校側との調整で困難が生じうる場合があることが明らかになった。第4に、少年が復学を行う場合、学校と同様に家庭との調整が必要であり、家庭との調整においても困難が生じ得ることが明らかになった。

This paper seeks to clarify the treatment in juvenile training schools and the difficulties encountered at the time of release, based on cases reported by legal instructors. The paper focuses on academic instruction in the juvenile training schools. There were four key conclusions. First, juveniles admitted to juvenile training school were found to have poor motivation toward for school life. For juveniles with negative prior experiences of schooling, the legal instructors’ practices were guided by their understanding of the juveniles’ backgrounds. Second, it was apparent that the instruction provided in juvenile training schools was not necessarily intended to improve academic performance. Third, it became clear that when a juvenile tries to return to junior high school, difficulties can arise in coordinating between the two institutions. Finally, when a juvenile returns to school, it is necessary to coordinate with both the school and the family as difficulties may arise in coordinating with the latter.
